1. Agreement to Terms

By accessing or using the AIGPT platform at aigpt5.org (the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

We may modify these Terms at any time. Material changes will be posted here with an updated date. Continued use constitutes acceptance.

2. Description of Service

AIGPT is a unified platform providing access to artificial intelligence models from multiple providers, including OpenAI, Anthropic, Google, xAI, and DeepSeek. The Service includes AI chat, web search, deep research, image generation, voice transcription and synthesis, and file-based question answering.

We act as an intermediary — routing your requests to third-party AI providers and delivering their responses. We do not develop or control the AI models themselves.

3. Accounts and Credits

3.1 Credits

The Service operates on a prepaid credit system. You purchase credits, which are consumed based on usage. Consumption varies by model and feature — details are displayed in the application.

3.2 Credit Balance

  • Credits are non-transferable unless explicitly authorized.
  • Credits do not expire under normal circumstances.
  • We may adjust pricing for future purchases or usage rates. Existing balances are not affected by price changes.
  • Your credit balance represents a prepaid service entitlement, not a stored monetary value, deposit, or financial instrument.

3.3 Account Security

You are responsible for maintaining the confidentiality of your access credentials and all activity under your account. Notify us immediately if you suspect unauthorized use.

4. Payments and Refunds

4.1 Payments

All payments are processed by Stripe, Inc. By making a purchase, you also agree to Stripe's Terms of Service. Prices are displayed in USD unless otherwise stated.

4.2 Refunds

  • Unused credits: Full refund within 14 days of purchase if no credits have been used.
  • Partially used: Handled case-by-case. Contact support with your request.
  • Platform errors: If credits were consumed due to a verifiable platform error (not AI response quality), we will restore the affected credits.
  • Chargebacks: Filing a chargeback without contacting us first may result in account suspension pending investigation.

4.3 Disputes

For billing disputes, contact [email protected] with your transaction details. We aim to resolve all disputes within 5 business days.

5. Acceptable Use

You agree not to use the Service to:

  • Generate content that is illegal in your jurisdiction or where our servers operate.
  • Generate child sexual abuse material or content exploiting minors.
  • Generate content designed to harass, threaten, or incite violence against individuals or groups.
  • Circumvent usage limits, billing, or access controls.
  • Reverse-engineer, scrape, or probe the Service infrastructure.
  • Resell or redistribute access without written permission.
  • Introduce malware, viruses, or harmful code.
  • Violate the acceptable use policies of the underlying AI providers.

Violation may result in immediate suspension or termination without refund.

6. Intellectual Property

6.1 Your Content

You retain ownership of the prompts you submit and original content you create using the Service, to the extent permitted by law. We do not claim ownership of your inputs or the AI-generated outputs you receive.

6.2 AI-Generated Content

AI-generated content is produced by third-party models. The intellectual property status of AI-generated content varies by jurisdiction. You are responsible for ensuring your use complies with applicable laws.

6.3 Our Property

The AIGPT name, logo, website design, and platform software are our property or licensed to us. You may not copy, modify, or redistribute them without permission.

7. Third-Party Services

The Service relies on third-party AI providers and infrastructure. We are not responsible for their availability, accuracy, or content. Providers may change models, pricing, or availability without notice. We make reasonable efforts to maintain continuity but cannot guarantee access to any specific model.

8. Service Availability

We strive for reliable service but do not guarantee uninterrupted or error-free operation. The Service is provided "as-is" and "as-available." We may perform maintenance or updates that temporarily affect availability, with reasonable notice for planned downtime.

9. Legal Restrictions and Export Compliance

The Service may not be available in all countries or jurisdictions. You are responsible for compliance with all local laws and regulations regarding the use of AI services in your jurisdiction. We may restrict or suspend access from certain regions as required by applicable law, export controls, or sanctions programs. You agree not to access the Service from any jurisdiction where doing so would violate local law or applicable trade restrictions.

10. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for indirect, incidental, special, consequential, or punitive damages.
  • We are not liable for the accuracy, quality, or suitability of AI-generated content.
  • Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
  • We are not responsible for decisions made based on AI-generated content.

11. Indemnification

You agree to indemnify and hold us harmless from claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of third-party rights.

12. Cancellation and Termination

  • Cancellation by you: You may cancel your account at any time by contacting us at [email protected]. There are no cancellation fees. Unused credits on voluntarily cancelled accounts are eligible for refund per Section 4.2.
  • Termination by us: We may suspend or terminate your account for Terms violations, suspected fraud, or extended inactivity (12+ months). We make reasonable efforts to notify you, except in cases of severe violations.
  • Effect: Upon cancellation or termination, your access to the Service ceases. Balances for accounts terminated due to violations are forfeited. For voluntary cancellations, see our refund policy in Section 4.2.

13. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that AI-generated content will be accurate, complete, or suitable for any purpose.

14. Governing Law

These Terms are governed by the laws of the jurisdiction in which our principal business operates, without regard to conflict-of-law provisions. Disputes shall be resolved through good-faith negotiation first, then binding arbitration if unresolved.

15. Severability

If any provision is found unenforceable, the remaining provisions continue in full force.
